1.             This STALLION BREEDING CONTRACT for the breeding season of 2008, is made and entered into the ____- day of _______, 2007 by and between Clearheart Connemaras/Jennifer Fitzpatrick, DVM, hereinafter designated “Stallion Owner”, and ____ ____________________________, hereinafter designated “Mare Owner”.

Mare Owner agrees to breed the mare______ ______________________ Reg. No. _ ________________, foaled in___________________, by _____________________________, out of____ ________________, hereinafter designated “Mare”.

to the Stallion Thurman Clearheart, Reg. No. S 662 XXXVIII, hereinafter designated “Stallion” for a fee of $1000.

¨       A booking fee of $200 is due upon execution of this contract by both Stallion Owner and Mare Owner.  Booking fee is discounted by $50 if paid in full by 12/31/06.

¨       A stud fee of $600 is due and payable prior to first collection of semen for shipment to Mare. 

¨       Collections are $200 each and will be payable by credit card to collecting veterinarian at the time of collection.  Subsequent collections are $200 each.

¨       All shipping charges are the responsibility of the Mare Owner and will be payable by credit card to the collecting veterinarian at the time of shipment.

¨       A $25 rental fee will be charged for the equitainer shipping container and billed to mare owner by collecting veterinarian.  Container must be returned in the condition it was received, if deemed damaged additional charges for container may apply. 

2.         The mare owner requests (if possible) the month of ___ ___________ for breeding.

3.         Mare Owner may not substitute another mare and embryo transplants are prohibited without prior written consent of the breeder.  There is no right of return to the Stallion if the Mare is sold or otherwise changes ownership after having been served by the Stallion.

4.         Reservations for semen: The receipt of the booking and stallion service fees confirms the Mare’s reservation to breed to the Stallion for the 2008 breeding season which extends from March1-August.31th.  All semen orders must be received at least 24 hours before the requested collection date. Same day orders cannot be accommodated by the collecting veterinarian.  All orders for semen will be filled as received, subject to availability of the Stallion’s semen. Semen collections will only be performed on Monday, Wednesday, and Friday.  Other days may be available if requested, but cannot be guaranteed.  No Sunday collections available.  The breeder will give notice, by phone, e-mail, or mail, to Mare Owners of any conflicts between the Stallion’s competition dates and the Mare Owner’s reserved breeding dates.

5.         The Mare shall be in healthy and sound breeding condition, free from infectious, contagious, and transmissible diseases including but not limited to EIA, CEM, and EVA. Mare shall be current on all vaccinations and dewormings.  Stallion Owner reserves the right to refuse Mare if not in satisfactory condition. If Mare is refused, the booking fee is non-refundable but all other fees, including the Stud fee, shall be refunded in full.  All non-maiden mares must have a negative intrauterine culture within 45 days of first semen shipment.  If the Mare is barren or does not settle, Stallion Owner requires a recent uterine biopsy (within 60 days) prior to rebreeding.

6.         The Stallion shall be in healthy and sound breeding condition- free from infectious, contagious, and transmissible diseases including EIA, CEM, and EVA, and current on vaccinations and dewormings.  Mare Owner reserves the right to refuse Stallion if not in satisfactory breeding condition as determined by the above conditions.  If Stallion is refused, the booking fee and stud fee will be refunded in full to Mare Owner.  It is understood that Stallion will not perform “live cover” of any mare, and if Stallion is so used Mare Owner is to be notified as soon as possible but before any semen is shipped to Mare.

7.         Semen will be tested by attending veterinarian or by Out West Stallion Station collection facility for quality and quantity prior to shipment, and sample evaluation will be included with the semen for shipment. Semen quality will also be tested by Mare Owner’s veterinarian or veterinarian’s technician within 3 hours of insemination of Mare.  Test results will be available to Stallion Owner.

8.         The Contract contains a "Live Foal Guarantee" (LFG). A live foal is described as a newborn foal which stands and nurses without assistance within 24 hours. If after being pronounced "safe in foal", the Mare should miscarry, abort, or prove barren the Mare Owner has the privilege to return for breeding during the 2007 or 2008 breeding season. If foal is born dead, or fails to stand and nurse without assistance within 24 hours, there are return privileges for the 2008 breeding season, only if Stallion Owner is notified in writing within 14 days and receives a veterinarian’s statement confirming cause of death. If Stallion should die, be sold by the Stallion Owner, or become unfit for return service in the 2009 season, the stud fee will be refunded. Written verification by veterinarian of appropriate mare care including all recommended vaccinations is required by Stallion Owner in order for LFG to be honored.  If mare fails to settle in foal prior to the end of the breeding season the Mare Owner has the privilege to return for breeding during the 2007 or 2008 breeding season with current mare or another mare if desired.  There is no return of stud fee for failure of mare to settle in foal unless stallion becomes unfit for service.

9.         Clearheart Connemaras is not responsible for lost, delayed, or damaged semen. 

10.        An ACPS Stallion Service Certificate will be issued for the foal, conceived by this mating, when stud fee and all other expenses have been paid in full, and when Mare has produced a live foal as defined in Paragraph 8 by this mating.

11.        It is further agreed, that should the Stallion die, be sold by the Stallion Owner, or become unfit for service, prior to settling the Mare, all booking and stud fees paid will be refunded, thereby canceling this contract. The LFG contained in Paragraph 8 remains in effect. If Mare dies or becomes unfit to breed, the Mare Owner has the option to breed Stallion to a different mare, subject to Paragraph 5 and Stallion Owner’s approval, or be refunded to stud fee only.

12.        This Contract is entered into in the State of Arizona and will be interpreted and enforced under the laws of that state.

13.        This Contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included unless specifically stated in this written Contract. Additional conditions should be individually initialed by each party. If none, initial here________.


When Mare Owner and Stallion Owner sign this Contract it will then be binding on both parties, subject to the above terms and conditions.
